Student Loans
Student loan debt has become one of the largest financial burdens facing American families. Whether you’re dealing with federal student loans, private student loans, defaulted loans, wage garnishment concerns, or changing repayment programs, understanding your options is critical.
Millions of Americans are facing the most significant student loan repayment changes in decades. Many borrowers do not realize that major Income-Driven Repayment (IDR) programs are ending, repayment options are changing, and failure to act could result in dramatically higher payments, damaged credit, collection activity, and financial hardship. To make matters worse The U.S. Departments of Education and Treasury announced an agreement to transfer the management of defaulted student loans to the Treasury Department. Borrowers who are behind on payments will now be at the mercy of the US Treasury dept. The U.S. Treasury (through the Bureau of the Fiscal Service and the IRS) is known for highly aggressive debt collection practices. Federal law mandates that the agency uses severe, sweeping measures to recover delinquent debts:
- The Treasury Offset Program: The Treasury can legally intercept, withhold, or reduce government payments to cover a delinquent debt. This includes withholding tax refunds, federal retirement benefits, military pay, and up to 15% of Social Security checks.
- Administrative Wage Garnishment: The Treasury can order employers to withhold portions of a debtor’s wages to satisfy what is owed without needing to take the debtor to court.
- Private Collection Agencies: For particularly difficult or longstanding debts, the Treasury partners with private collection agencies to pursue individuals.
- Asset Seizure and Liens: Through the IRS, the Treasury utilizes enforced collections, property seizures, and federal liens.
